PLEASE READ THIS DOCUMENT CAREFULLY. THIS DOCUMENT CONTAINS IMPORTANT INFORMATION ABOUT COVERAGE UNDER THIS WARRANTY, INCLUDING YOUR OBLIGATIONS, YOUR RIGHTS UNDER THE AUSTRALIAN CONSUMER LAW, AND OTHER IMPORTANT CONDITIONS, LIMITATIONS, AND EXCLUSIONS.

This warranty against defects is given by PC Case Gear Pty Ltd (ACN 099 808 072).

What is covered by this warranty?

Subject to the conditions, limitations, and exclusions contained in this warranty, we offer a limited warranty which applies to:
1. all custom system products that are assembled by us under our custom system assembly service; and
2. any standalone components, loose parts, or other goods that we have expressly confirmed have the benefit of this warranty (whether at or before the time of original purchase),

collectively and individually the “Products”.

This warranty does not cover products that we have not assembled, customised, nor otherwise serviced (for example, products sold in manufacturer’s packaging).

Where we have provided you with a separate warranty covering specific Products, the terms and conditions of this warranty do not apply.

To whom is this warranty given?

This warranty is given to the original purchaser of the Products (“Customer,” “you”).

You may only transfer or assign the benefit of this warranty with our prior written and fully informed consent. This warranty is otherwise non-transferrable.

You acknowledge and agree that, given the nature of our Products and industry, we may be reasonably required to, and we reserve our right, to subcontract under this warranty however doing so will not relieve us of our obligations to you.

Our warranty

We warrant that the Products will be free from defects in design, materials, and workmanship which arise under their normal intended use, and which would render them unserviceable or unfit for their normal intended use (or any other particular use specified by you, and agreed by us, as a term of your order prior to the Products being supplied).

Our obligations under this warranty

At our reasonable election, and subject to the terms of this warranty, we will refund, replace, or repair the Products that are the subject of your warranty claim, if:
3. we agree the Products have a defect that is covered by this warranty; and
4. you have:
    1) satisfied the pre-conditions for making a warranty claim; and
    2) made a warranty claim within the Warranty Period; and
    3) completed any other requirements set out herein.

Warranty period

The applicable warranty period for the Products is two (2) years (the “Warranty Period”).

We are only obliged to consider your warranty claim if you submit your claim to us within the Warranty Period.

Commencement of Warranty Period

If you acquire the Products from us, the Warranty Period commences from the date:
1. that the Products are delivered; or
2. when you otherwise take possession of the Products,

whichever occurs first in time (the earliest date).

Pre-conditions for making a warranty claim

To receive the benefit of this warranty:
1. all invoices relating to the Products that are the subject of your warranty claim must be paid in full, OR your commercial credit account with us must be in good standing and not in default;
2. the Products that are the subject of your warranty claim must have been supplied by us; and
3. you must notify us within thirty (30) days of identifying a problem or defect that you wish to claim a remedy for under this warranty.

How to make a claim under this warranty

To make a claim under this warranty you must, prior to the expiry of the relevant Warranty Period and within thirty (30) days of discovering the Products’ defect:
1. notify us in writing of your warranty claim using the ‘Contact Details’ overleaf; and
2. provide us with clear and legible details of your warranty claim (including the relevant defects, Products’ name, and date of delivery); and
3. (if reasonably requested by us) provide us with your evidence of purchase and further information.

Evidence of purchase and further information

We may request additional details or materials (such as photographic or video evidence) required by us to assess your warranty claim.

Given the nature of the Products and the potential risk created by defects, we may also require you to provide further information that is reasonably required by for us to assess your warranty claim, including but not limited to:
1. delivery information; or
2. usage, maintenance, or storage information.

We may also ask you to provide one of the following legible proof of purchase documents:
1. receipts;
2. tax invoices; or
3. a credit card or bank statement.

Upon receipt of your warranty claim and relevant documentation, we may contact you to arrange for a time for us or our authorised representative to inspect the Products that are the subject of your warranty claim.

You are responsible for any expenses of making a claim under this warranty.

Successful warranty claims

Where we agree to accept your warranty claim, repairs or a replacement Product (or, where no replacement product is available, an agreed equivalent product) will be provided to you:
1. free of charge; and
2. in the same condition as the Products that were originally supplied.

We may also agree to refund you where repairs or a suitable replacement product are not available.

Repairs and replacement products

Where we have agreed to repair the Products at premises other than our own, you must give us and our personnel at all reasonable times free, clear, and unrestricted access to the relevant premises to enable us to fulfil our obligations without unreasonable interruption, impediment, delay, or obstruction.

Where we have agreed to replace the Product, the replacement product will be made available for your pickup (at no cost to you), from the nearest distributor as notified by us, or at an alternative location as mutually agreed. We may also arrange for free delivery (by road freight) of the repaired or replacement Products.

If an exact replacement is not available and we have agreed to replace the Products with a different or substantially similar product, we will take reasonable steps to ensure that the replacement product will be comparable to the Products which have been replaced in terms of its appearance, quality, and specifications (wherever possible).

No extension to Warranty Period

Unless otherwise agreed by us in writing:
1. replacements carried out by us under this warranty will not extend the Warranty Period, nor will they result in the Warranty Period being restarted, nor a new Warranty Period being initiated; and
2. the warranty period in respect of any replacements will end upon the expiration of the initial Warranty Period.

What is expressly excluded from this warranty?

For the purposes of this warranty, and for the removal of doubt, we will not be obliged to repair, replace, or refund any Products that are the subject of damage caused by:
1. normal wear and tear;
2. misuse or abuse (whether wilful, accidental, or negligent);
3. any use of Products other than their normal intended use or in an application that is not fit for purpose (including hardware failures resulting from overclocking beyond manufacturer specifications, or severe thermal damage caused by inadequate user-installed cooling solutions);
4. use of Products for cryptocurrency mining or continuous high-load data farming;
5. non-compliance with relevant legislation, codes, standards, or other laws;
6. colour fading naturally or occurring by normal usage;
7. external forces (including impact damage);
8. improper assembly including bent or broken CPU socket pins, severed PCB traces, or damaged component contact pads;
9. improper maintenance (including cleaning), handling, or storage;
10. improper installation (where the original installation was not carried out by us or our authorised supplier, or where installation was not carried out in accordance with our installation guidelines or those of the relevant manufacturer);
11. exposure to excessive: heat, radiation, or oxidative, corrosive, or caustic chemicals;
12. exposure to loads or stresses in excess of the relevant Products’ specifications and our installation guidelines (or those of the relevant manufacturer);
13. exposure to liquids and spills;
14. modifications, alterations, or repairs made outside of our or the relevant manufacturer’s recommendations (including fitting of non-approved products);
15. unauthorised modifications to core components including but not limited to CPU delidding, application of conductive liquid metal thermal interfaces (we recommend that you always speak with us if you are in doubt or do not understand your obligations under this exclusion);
16. natural events or disasters, including, without limitation, explosion, contamination, fire, lightning, hail, earthquakes, or floods; or
17. deterioration or damage to Products that occurs during transit where risk in the Products has passed to you in accordance with our Terms of Trade (including for example, where you or your nominated carrier has collected Products from our premises).

Inspection and delivery fees

We reserve the right to charge you a service fee for the inspection of any Products that are the subject of your warranty claim. If we or our authorised representative inspect the Products and determine there to be a defect that is covered by this warranty, then we will waive or refund the service fee.

You are responsible for the costs of transporting or delivering to us the Products the subject of your warranty claim. If we or our authorised representative inspect the Products and determine there to be a defect that is covered by this warranty, then we will waive or agree to refund the reasonable costs of delivery or transport that you have incurred. We may also arrange for free delivery (by road freight) of the repaired or replacement Products.

Installation and labour costs

Where labour is included within the relevant Warranty Period, any replacement or repair of the Products or its parts covered by this warranty will be performed by us or our authorised representative or supplier.

Unless otherwise agreed, we are not responsible for any labour costs, including but not limited to, installation costs (where we or our authorised supplier or representative were not responsible for the original installation), accommodation, travel, modifications to surrounding fixtures, cabinetry, tiling, plumbing, or other works required to accommodate the repairs or replacement Products or parts.

Further limitations and exclusions

Unless agreed otherwise and to the extent permitted by law, this warranty expressly excludes:
1. delivery, freight, and other transport costs;
2. handling, warehousing, and other storage costs;
3. the costs of:
    1) uninstalling, removing, and disposing of the Products the subject of your warranty claim; and
    2) installing the replacement or repaired Products;
4. damage to personal property or real property;
5. liability for any liquidated damages you incur; and
6. costs associated with third-party evaluations, reports, or repairs that have been undertaken without our prior written consent.

We will rectify any defect as soon as practicable but we will not be liable for any loss or damage whatsoever caused by delays.

Replacement or repair facilities

Given that Products may be discontinued from time to time, we cannot guarantee that replacement or repair facilities will be available after the relevant Warranty Period.

Risk in Products (goods)

Risk of loss or damage to the repaired or replacement Products passes to you, to your agent, or to your nominated carrier, upon delivery or collection of the repaired or replacement goods (as the context requires).

Limitation of liability

To the extent permitted by law, our liability under this warranty is limited to us refunding, repairing, or replacing the defective Products that are the subject of your warranty claim, or (with your agreement) supplying you with equivalent Products.

No party is liable to the other party for any ‘Consequential Loss’ (as that term is defined in our Terms of Trade) however caused arising out of or in connection with this warranty.

No exclusion or limitation of statutory rights

Nothing in this warranty is to be read or construed to exclude, limit, or modify or have the effect of excluding, limiting, or modifying any right or remedy, or any guarantee, term, condition, warranty, or undertaking implied or imposed by any state or federal legislation which cannot lawfully be excluded or limited.

Australian Consumer Law

This section applies where you are deemed to be a ‘consumer’ for the purposes of Schedule 2 to the Competition and Consumer Act 2010 (Cth) (“Australian Consumer Law”).

The benefits given to you under this Warranty are in addition to any rights and remedies that you may have under Australian Consumer Law.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service. This is not an exhaustive list of your rights under the Australian Consumer Law.

Manufacturer warranties

This warranty is separate to any warranty against defects that is or may be provided by other manufacturers or upstream suppliers.

We do not accept responsibility for any warranty against defects in respect of Products (including manufacturer warranties) other than as expressly provided for in this warranty or as required by law.

If we are not the actual manufacturer of the Products then we may, upon reasonable request, notify you in writing of the relevant manufacturer’s place of business so that you may direct any separate warranty claims to the manufacturer offering such warranties.

Privacy policy and your personal information

We cannot assess warranty claims without collecting and using your personal information.

By submitting a warranty claim you consent to us reasonably collecting and using your personal information for the purposes of assessing your warranty claim.
